Getting the Child Custody Order You Want

Your child custody order is the legally binding document that the court adopts in your child custody case. The court accepts a child custody agreement into an order and then you are required by law to live by the terms and conditions set forth in that order. The custody order is essentially the rule book for you custody situation.

Because the court order is a legal document, it has the most impact on your custody case. You need to know how to get the custody agreement you want accepted as the order. Here is some of the information included in the custody order so you can prepare.

1. The schedule of custody and visitation. The order lays out the custody and visitation plan that the parents have to follow. It states if the couple has joint custody or sole custody with visits.

The repeating pattern that the parents set up for their schedule will also be included in the order. It will lay out the times that the child is with each parent and tell the dates that this arrangement covers. It will also show the percentage of time that the mother and father have with the child.

2. A schedule of holidays. The order will have a list of holidays and show which parent has custody on that holiday. It should also specify the length of the holidays.

3. Child support information. Courts generally figure out child support using either the time-share percentage that each parent has with the child or an overnight percentage, the amount of income of both parents, and information about insurance and similar things. The amount of child support that has to paid will be shown in the order.

4. Extra provisions and stipulations. Any other information that the parents want to add to their agreement will go in the order. This includes any provisions about raising the child that the parents want to legally enforce.
